Florida Parenting Plan Basic Terminology

​A parenting plan, in Florida, is the written document that states how you and the other parent will continue to care for your child after you divorce.

The terms parental responsibility and time-sharing are used in the parenting plan instead of custody and visitation.

Parental responsibility refers to the authority parents have to make decisions about the child's education, discipline, religious upbringing, health care, and other matters. You can have shared or sole parental responsibility.

Shared parental responsibility is when both parents make decisions for and about the child. Parents can divide responsibilities or one parent can have responsibility over specific areas. The court generally prefers shared parental responsibility and typically orders it unless it is not in the best interest of the child.

Sole parental responsibility is when one parent has the right to make all decisions without consulting the other parent. You can have sole parental responsibility with or without time-sharing with the other parent. The court will generally order sole parental responsibility only if it is best for the child.

Time-sharing refers to when each parent spends time with the child.

Using mediation as early as possible in the divorce process is the smartest way to reduce your cost. This is especially true if the divorcing spouses have hired lawyers, who are paid by the hour. Another important tip (rarely shared) is that, in South Florida, the Courts almost universally require mediation anyhow. So, both spouses can agree to voluntarily mediate as early as possible, with the help of the mediator work out a settlement that works for both spouses, save tens of thousands of dollars by not paying 2 separate lawyers to litigate your case in court for months and months. Alternatively, both spouses can hire and pay 2 separate lawyers thousands (or even tens of thousands) of your assets to litigate the case for months, and then go to mediation to settle the case or, worse yet, not settle the case and then pay even more money for a trial (where both spouses turn the decision-making responsibility over to a judge). Bottom line…

Mediation gives people a quick, inexpensive way to work out their differences while addressing everyone’s needs and interests. Decisions reached in mediation are created by the people who are in conflict, not imposed on them by a judge. Mediation:
  • encourages direct communication between the parties
  • helps people decide for themselves
  • allows for the expression of emotions
  • defuses anger
  • explores creative means of solving problems
  • promotes cooperation
  • preserves the strengths of an ongoing relationship
  • helps people accept the consequences of their own decisions
  • develops a model for resolution of future conflicts
Mediation is a way for people who are having a dispute to talk about their issues and concerns and to make decisions about the dispute with the help of another person (called a mediator). A mediator is not allowed to decide who is right or wrong or to tell you how to resolve your dispute.  In mediation, you can try to find solutions that make sense to you and the other person in the dispute to resolve some or all of your concerns. 

While the goal is to try to work something out, you may decide it would be better for you not to come to an agreement. Sometimes emotions may be driving the dispute which can make talking to the person or party with whom you are in a dispute difficult.  A mediator can assist you in easing the way for communication. The mediator is there as a neutral person to help you focus on solving your dispute; however, the mediator is prohibited from providing therapy, counseling or legal advice.
