Initial DivorceThis includes negotiating and drafting a Marital Settlement Agreement, which includes dividing up all of the assets and liabilities, negotiating spousal support (alimony), if applicable, as well as all of the details. If children of the marriage are involved, then a comprehensive Parenting Plan is also developed and child support is calculated.

Parenting PlansThe Parenting Plan (required if a child or children of the marriage) is the comprehensive document that is the blueprint to all the details as to both parents rights and responsibilities as to parenting issues (including decision making, school issues, activities, visitation schedule-- includes all holidays, summer and vacations, parental cost sharing and many other details).

RelocationsSometimes one parent needs (for example - job required) to move further away within the state, outside the state or even out of the country. Plans can often be negotiated that are customized to the specific situation which are in the best interest of the child/children and attempt to preserve both parental relationships. The logistics of a workable plan are critical.

Child SupportChild support, if applicable, is generally based upon a formula involving several variables relating to the income of the parents, certain expenses for the child/children and the number of overnights spent with each parent and a few other factors. While the formula is a guideline, parents can negotiate deviations in certain circumstances.

Post-Divorce IssuesAs time goes on past the initial divorce, unforeseen issues of tend to arise. Solutions to these types of issues are best when crafted by the ex-spouses through mediation to specifically address their unique circumstances and requirements. After all, it is the ex-spouses that will have to live with and ultimately implement the solutions.

Alimony/Spousal SupportSpousal Support (used to be called "alimony") is available in a variety of forms and types (including: temporary, bridge-the-gap, lump sum, rehabilitative, durational and permanent periodic). The financial need of the receiving party and the ability to pay of the spouse paying spousal support are key considerations. These negotiations are fully documented in the Martial Settlement Agreement.

VisitationThe parents are in the best position to negotiate a workable visitation schedule that is in the best interest of the child/children. Details to negotiate often include the days of the week the child is with each parent, summer vacations and holidays. Additionally, the specifics as to pick-up and drop-off are also negotiated and documented.

Property DistributionEventually, a decision needs to be made as to how to exactly how to divide up all of the assets (examples: cash, savings, retirement, house, car, boat, furnishings, etc...) and all of the liabilities (examples: house, car & boat loans, credit card balances, etc...). The details of the negotiations are incorporated into the Martial Settlement Agreement.
